These general conditions have as their object the purchase of products made remotely via telematic network through the website www.tenutamonteti.it owned by Tenuta Monteti Srl with headquarters in Strada della Sgrilla 6, 58011 Capalbio (Gr), tel. (+39) 0564 896160, fax. (+39) 0564 896783, e-mail: info@tenutamonteti.it The purchase operations will be regulated by the provisions of Legislative Decree no. 185 of 22.5.1999, while the protection of confidentiality will be subject to the discipline of Legislative Decree 196/03.
Art.1: ACCEPTANCE OF THE CONDITIONS OF SALE
1.1 The conditions set out in the introduction are an integral and essential part of this contract.
1.2 All contracts will be concluded directly through the consumer customer accessing the website www.tenutamonteti.it, where the customer can conclude the contract for the purchase of the desired product by carefully following the instructions and procedures provided.
1.3 These general conditions of sale must be examined “online” by the customer, before completing the purchase procedure. The forwarding of the order confirmation therefore implies full knowledge of the same and their full acceptance.
Art. 2: SALES PRICES AND PURCHASE METHODS
2.1 All sales prices of the products displayed and indicated on the website www.tenutamonteti.it include VAT and any other tax.
2.2 The total cost of shipping to the customer’s home is borne by Tenuta Monteti S.r.l., upon reaching the minimum required expenditure (Art. 10).
2.3 The purchase contract is finalized through the exact compilation and consent to the purchase expressed through the adhesion given “online”.
2.4 The customer can pay for the goods ordered using the payment methods indicated “online” at the time of purchase.
2.5 In case of payment by bank transfer, the shipment of the ordered products will be made upon confirmation of the actual credit on the Tenuta Monteti Srl account, which must occur within and no later than ten working days from the date of acceptance of the order, after which the order is automatically considered cancelled. The data for the bank transfer will be communicated at the end of the order procedure.
Art. 3: DELIVERY METHODS
3.1 Tenuta Monteti Srl will deliver to the customer, at the address indicated by him at the time of the order, the products selected and ordered with the methods set out in the previous article, by couriers.
Art. 4: RESPONSIBILITY
4.1 Tenuta Monteti Srl assumes no responsibility for disruptions attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, the execution of the contract within the agreed timeframes.
4.2 Tenuta Monteti Srl is not responsible for any fraudulent or illicit use that may be made by third parties of credit cards, checks and other means of payment, when paying for the products purchased. In fact, Tenuta Monteti Srl is not able to know the buyer’s credit card number at any time during the purchase procedure, which is transmitted directly to the banking service manager via a protected connection.
Art. 5: GUARANTEES
5.1 Tenuta Monteti Srl guarantees that the products delivered will be the same as those indicated and described on the site.
Art. 6: BUYER’S OBLIGATIONS
6.1 The buyer is strictly prohibited from entering false and/or invented and/or imaginary data in the registration procedure required to activate the process for the execution of this contract and the related further communications.
6.2 The Customer indemnifies Tenuta Monteti Srl from any liability arising from the issuing of incorrect tax documents due to errors relating to the data provided by the Customer, the Customer being solely responsible for the correct entry.
Art. 7: RIGHT OF WITHDRAWAL
7.1 Pursuant to art. 5 of Legislative Decree 22 May 1999, no. 185, the customer may exercise the right of withdrawal, returning the goods received and obtaining a refund of the price paid.
7.2 The consumer who for any reason is not satisfied with the purchase made, has the right to withdraw from the contract stipulated, without any penalty and without specifying the reason, within 10 working days from the day of receipt of the goods purchased.
7.3 All costs of returning the products are borne by the customer who, directly or by other means, will arrange for their delivery to the seller’s address.
7.4 To exercise the right of withdrawal, the customer must, within the deadline indicated above, send a registered letter with receipt to Tenuta Monteti S.r.l., Strada della Sgrilla 6, 58011 Capalbio (Gr) or an e-mail to customercare@tenutamonteti.it.
7.5 Tenuta Monteti S.r.l. will accept the returned goods, reserving the right to verify that the products have been returned in their original condition and with the original packaging; in this case, it will forward the amount paid by the consumer for the purchase of the products.
7.6 The transport costs incurred for the delivery of the product to the customer and for any return to Tenuta Monteti, owner of the website www.tenutamonteti.it, are not refundable.
Art. 8: PRIVACY
8.1 The personal data requested during the order process are collected by Tenuta Monteti S.r.l. and processed on computer media, in order to satisfy the obligations arising from the contract concluded with the customer and will not be transferred to third parties under any circumstances and for any reason.
8.2 Tenuta Monteti S.r.l. guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code pursuant to Legislative Decree No. 196 of 30.06.03.

8.4 The Customer, at any time, has the right to revoke consent to the processing of personal data by sending a written communication to Tenuta Monteti S.r.l., at the address above.
8.5 The Customer, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access his/her data according to the methods set out therein.
Art. 9: COMPLAINTS
9.1 Any complaints must be addressed by letter to Tenuta Monteti S.r.l., Strada della Sgrilla 6, 58011 Capalbio (Gr), or by e-mail to customercare@tenutamonteti.it.
Art. 10: SHIPPING TERMS
In order to guarantee you an excellent service, all our shipments are entrusted to the best couriers.Deliveries will generally be made within 3-4 working days from the date of shipment, depending on the requested destination.
Upon delivery of the order, we invite you to verify that the number of packages indicated on the carrier’s letter corresponds to the number delivered, and that the package is intact and undamaged; any damage must be immediately reported to the courier who makes the delivery and by e-mail to customercare@tenutamonteti.it
